A-25, r. 3 - Regulation respecting insurance contributions

32. In the case of a person whose probationary licence was revoked or the right to one suspended under section 180 of the Highway Safety Code (chapter C-24.2) and who subsequently obtains a new probationary licence, must pay upon issue of this new licence the insurance contribution equal to the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions as follows:
(1)  the insurance contribution determined as follows:
(a)  where the probationary licence bears one or more of classes 4A, 4B, 4C and 5, the insurance contribution is the product obtained by multiplying the monthly insurance contribution by the number of months, including parts of months, less 1, during which the holder is authorized to drive; the monthly insurance contribution is the quotient obtained in dividing by 24 the insurance contribution set as follows:
i.  where the year of probationary licence issue is 2008, 2009 or 2010, according to the year of initial probationary licence issue, its classes and total number of demerit points entered on the person’s record during the 2 years prior to the date of initial probationary licence issue as shown in the table under subparagraph a of paragraph 1 of section 30;
ii.  where the year of issue of a probationary licence is after 2010, the insurance contribution is set by indexing on 1 January of the year of issue in accordance with sections 42 and 43, the insurance contribution for the preceding year, before adjustment under section 45, according to the classes of the holder’s initial probationary licence and the total number of demerit points entered on the person’s record during the 2 years prior to the date of initial probationary licence issue;
(b)  where the probationary licence bears one or more of classes 6A, 6B and 6C, the insurance contribution is the sum of insurance contributions for the months, including parts of months, during which the holder is authorized to drive, except for the last month; the insurance contribution for a month corresponds to the percentage, determined under section 14, of an amount equivalent to half of the insurance contribution, calculated according to subparagraph a;
(c)  where the probationary licence bears one or more of classes 4A, 4B, 4C and 5, and one or more of classes 6A, 6B and 6C, the insurance contribution is the sum of insurance contributions as follows:
i.  that calculated according to subparagraph a;
ii.  that calculated by adding together the insurance contributions for the months, including parts of months, during which the holder is authorized to drive, except for the last month; the insurance contribution for a month corresponds to the percentage, as determined under section 14, of an amount equivalent to half of the insurance contribution calculated according to subparagraph a, for the holder of a licence bearing one or more of classes 6A, 6B or 6C with no demerit point;
(2)  that calculated according to paragraph 2 of section 30.
For the purposes of applying the first paragraph, where more than 5 years have elapsed between the start of the 2 years that should have entered into the calculation of demerit points and new probationary licence issue, another 2-year period must be determined for calculating points as follows:
(1)  for determining the date of the end of the new period of 2 years, 24 months are added to the date marking the end of the period of 2 years that was to be used;
(2)  for determining the date of the start of the new period of 2 years, 1 day is added to the date marking the end of the period of 2 years that was to be used;
(3)  the calculations prescribed in paragraphs 1 and 2 are repeated until the length of time from the start of the period of 2 years that must be used for calculating demerit points and issue of a new licence is less than 5 years.
